Happy Cup Warehouse - may hereon be referred to as ‘Happy Cup Warehouse, we or us'.
Happy Cup Warehouse will make all reasonable efforts to meet a Customers delivery request, however the date and time for any delivery is an estimate only. As such we will not be liable for any loss suffered by the Customer or any third-party due to late delivery. Please note many factors including shipping and packing, and time spent in Customs all contribute to the overall time taken for a delivery to arrive.
Happy Cup Warehouse will not insure any goods shipped, couriered, or otherwise transported to the Customer. We will not be liable to the Customer or any third-party for any loss or damage caused whilst being shipped, couriered or otherwise transported.
Happy Cup Warehouse may deliver the goods ordered by the Customer in instalments unless otherwise agreed to in writing. Delivery of goods to the Customer in instalments does not entitle the Customer to cancel their order.
Returns and Exchange Policy
Happy Cup Warehouse will accept, for return or exchange, items that are in new condition, unused, unaltered and free of damage by the customer and must have proof of purchase. Please return your purchase within three (3) days from receipt of the shipment. Items cannot be returned or exchanged after three (3) days from the receipt of shipment. All items must be returned in their original packaging. Please email firstname.lastname@example.org with your request.
A minimum of 30% of restocking fee will applied for returns. Once we receive your item, it will be inspected and we will notify you of the status of your refund.
The Customer will be responsible for paying for any return shipping costs for the item/s. Shipping costs are non-refundable.
Happy Cup Warehouse reserves the right to change, correct, amend or supplement the pricing and information contained in this web site without prior notice.
Prices include all additional applicable Goods and Service Taxes (G.S.T.). All prices set out on this web site are:
- Exclusive of G.S.T.
- Valid until any dates specified.
- Subject to stock being available to complete any/all orders.
Happy Cup Warehouse relies upon the Customer to ensure orders are accurate. It is the responsibility of the Customer to ensure they have placed the correct order for any amount of goods they require.
All orders placed on the Happy Cup Warehouse website will be payable immediately through either a third-party gateway or our standard Credit Card processing facility. Or in the case of an account customer within Seven (7) days of the date of the invoice.
If the Customer does not pay Happy Cup Warehouse for the goods within the time prescribed, the Customer acknowledges and agrees that:
We may pursue legal representation to recover any amounts owing; and
The Customer will be liable for Happy Cup Warehouse's legal fees to recover any amounts owing.
We may discontinue performance if the Customer fails to pay any sum due, or fails to perform under this or any other agreement if after seven (7) days written notice, the failure has not been resolved.
Cancellation of any order will be at the sole discretion of Happy Cup Warehouse.
We are not under any obligation to accept, or reimburse the Customer for, any unused products that are returned.
Defective Products and Shortages
If the Customer believes that the product is defective, the Customer must:
Notify Happy Cup Warehouse in writing of the alleged defect within seven (7) days of receipt of the product; and
If the Customer alleges the product is defective, return the product (at the Customers expense) in its original packaging and inform us of the invoice number and delivery date.
The Customer will be deemed to have accepted the product unless they notify us otherwise within seven (7) days of receipt of the product.
If we are not satisfied that the product is defective, we will be under no obligation to replace the product or refund to the Customer any costs. We will not replace any allegedly defective goods or refund the customer the cost of the goods if they were damaged or broken whilst at the risk of the Customer or at the Customers premises.
Any orders placed by a Customer on our website will create fully enforceable obligations that will be subject to these terms and conditions.
Happy Cup Warehouse will not be liable for any performance delays or for non-performance, due to causes beyond our reasonable control.
The Customer may not assign any rights or obligations hereunder without prior written consent from Happy Cup Warehouse.
If any term or provision herein is determined to be illegal or unenforceable, the validity or enforceability of the remainder of the terms or provisions herein will remain in effect.
These terms and conditions constitute the entire agreement between Happy Cup Warehouse and the Customer, and supersede any previous communications, representations or agreements between the parties, whether oral or written; any additional or different terms and conditions will not apply. The purchase of goods will constitute the Customers acceptance of these terms and conditions. The Customer acknowledges and agrees that the supply of all goods by Happy Cup Warehouse will be governed solely by the terms and conditions set out on this page.
Happy Cup Warehouse gives those warranties implied by consumer protection legislation in relation to the product. All other warranties are excluded to the extent permitted by law.
